1. Who we are

This website, https://emsensestore.com (the "Site"), is operated by CloudRange Commerce LLC, a limited liability company registered in the State of Florida, United States, with its registered address at 13145 NE 12th Ave, North Miami, FL 33161, USA ("we", "us", "our"). We sell EMSense at-home massage devices to consumers through the Site as an independent authorized reseller.

2. These terms

These Terms of Sale (the "Terms") apply to every order you place through the Site and to your use of the Site. By placing an order you confirm that you are at least 18 years old, that you are buying for your own personal, non-commercial use, and that you accept these Terms together with our Privacy Notice, Shipping Policy and Return & Refund Policy, which form part of them.

If you do not agree with these Terms, please do not use the Site or place an order. Nothing in these Terms limits any rights you have under the consumer protection laws of the place where you live that cannot be excluded by contract.

3. Products and one-time purchases

Every product on the Site is sold as a one-time purchase. We do not offer subscriptions, recurring shipments, trials or automatic renewals, and we will never charge your payment method again without a new order from you.

Bundles are described by the number of units they contain (for example "2 massagers" or "1 pair"); the product is identical in every bundle. Product images are for illustration and the actual item may differ slightly in colour or finish. What is in the box is listed on each product page.

4. Ordering and order acceptance

Your order is an offer to buy. You will see an order confirmation page and receive an order confirmation e-mail once your payment has been authorised; a contract for the products is formed when we dispatch them to you. We may refuse or cancel an order before dispatch, for example where a product is unavailable, where a pricing or description error is found, where payment cannot be verified, or where we suspect fraud or a purchase for resale. If we cancel an order that has been paid, we refund the full amount to the original payment method.

Please check your delivery address and contact details carefully before completing the order. If you notice an error, e-mail support@emsensestore.com immediately; once an order has been handed to the carrier the address can no longer be changed.

5. Prices and payment

Prices shown on the product pages are in US dollars. Checkout pages for the United Kingdom and Europe show prices in the local currency (GBP, EUR, NOK or SEK). The price, any shipping charge and the total are always displayed on the checkout page before you confirm the order; the amount shown as "Total charged today" is the full amount you pay us. Applicable sales taxes or VAT are included where the checkout says so; customs duties and import fees on international deliveries are described in the Shipping Policy.

We accept major credit and debit cards, Apple Pay and Google Pay and, on certain regional checkouts, Klarna and iDEAL. Payments are processed by third-party payment service providers on secure, encrypted connections; we never see or store your full card number. By submitting a payment you confirm that you are authorised to use the payment method. If a payment provider offers you financing or "pay later" options, that arrangement is between you and the provider under its own terms.

We try to keep prices and descriptions accurate. If we discover an obvious error in the price of a product you have ordered, we will contact you before dispatch and give you the choice of confirming the order at the correct price or cancelling it for a full refund.

6. Shipping and delivery

Orders are dispatched within 2 business days of order acceptance and shipped with tracking. Estimated delivery times by destination, how to track a parcel, what happens with damaged or lost parcels and how customs charges are handled are set out in our Shipping Policy, which forms part of these Terms. Delivery times are estimates, not guarantees. Risk in the products passes to you when they are delivered to the address you gave us.

7. Returns and refunds

You may return an unopened, unused product in its original packaging within 30 days of delivery for a refund of the purchase price, following the steps in our Return & Refund Policy. Customers in the European Union, Norway and the United Kingdom also have a statutory 14-day right of withdrawal, described in the same policy. Refunds are issued to the original payment method.

8. Product use and safety

EMSense products are personal-care massage devices for home use. Please read the directions printed in the pack before first use and charge the device fully before using it for the first time. Use the device only as described; do not modify it, use it with a damaged cable or housing, or leave it charging unattended.

EMSense is not a medical device. If you are pregnant, or have a pacemaker or another implanted electronic device, consult your physician before use. 9. Warranty and disclaimer

If a product arrives damaged or is defective, contact us within a reasonable time with photos and your order number and we will replace it or refund it as described in the Return & Refund Policy. This is in addition to any guarantee of conformity or implied warranty you are entitled to by law.

Except as expressly stated in these Terms and to the fullest extent permitted by law, the products and the Site are provided "as is" and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to an order or the use of the Site is limited to the amount you paid us for the order concerned, and we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, however caused. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded by law.

11. Use of the Site and intellectual property

The Site, its design, text, images, videos and logos are owned by us or used under licence from the brand owner and are protected by copyright and trademark laws. You may view and print pages for your personal use in connection with an order; any other reproduction, distribution or commercial use requires our written permission. You agree not to interfere with the operation of the Site, to attempt to gain unauthorised access to it, or to use automated tools to scrape it. "EMSense" and the EMSense logo are trademarks used with permission.

12. Privacy

We process the personal information you give us to fulfil your order, keep you informed about it and provide support, as described in our Privacy Notice.

13. Governing law and disputes

These Terms and every order placed through the Site are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules, and by any mandatory consumer protection laws of the country in which you live. If you have a complaint, please e-mail support@emsensestore.com first - most issues are resolved quickly and informally. Any dispute that cannot be resolved this way shall be brought in the state or federal courts located in the State of Florida, unless the law of your country of residence gives you the right to bring proceedings in your local courts, in which case that right is not affected. 14. General

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours to a successor operator of the Site, provided your rights are not reduced. These Terms, together with the policies referred to in them and your order confirmation, are the entire agreement between you and us in relation to an order.

15. Changes to these Terms

We may update these Terms from time to time by posting the revised version on this page with a new "last updated" date. The Terms in force when you place an order apply to that order.
